6. Consent

By accessing or using our services, you acknowledge and agree to the terms outlined in this Privacy Policy. Where we rely on your consent as the legal basis for processing your personal data (e.g., for marketing subscriptions or cookie use), you may withdraw that consent at any time.

Consent may be provided through:

  • Submitting opt-in forms on our website (e.g., contact forms, newsletter subscriptions)

  • Actively checking a box or toggling a setting to indicate agreement

  • Continuing to use our website after being presented with a clear notice (e.g., cookie banner)

You can withdraw your consent at any time by contacting us at privacy@leadperk.ca, or by using opt-out links in our communications. Withdrawing consent does not affect the lawfulness of processing conducted before your withdrawal.

Note: In some cases, particularly for B2B communications, we may rely on our legitimate interests or applicable implied consent rules under relevant data protection laws to contact you. You always have the right to opt out of such communications at any time. This provision applies only where permitted by local law (e.g., implied consent under Canadian anti-spam legislation).

We do not collect or process sensitive personal data unless we have obtained your explicit consent and it is necessary for a clearly defined and lawful purpose as permitted by applicable data protection laws.

7. Legal Basis for Processing

We only collect and process personal data when we have a lawful basis to do so. The legal basis depends on the type of personal data, the purpose for processing, and the jurisdiction involved.

7.1 Canada

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. Our primary basis for processing personal information is your knowledge and consent. In certain cases, we may also process personal data without consent where permitted by law — for example, to prevent fraud, ensure network security, comply with legal obligations, or for other reasonable purposes that a reasonable person would consider appropriate in the circumstances.

7.2 United States

We process personal data in accordance with relevant federal and state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), and similar frameworks. Our legal bases include:

  • Contractual necessity – to perform a contract with you or provide requested services.

  • Consent – where required by law or for specific categories of processing.

  • Legal obligations – where processing is necessary to comply with applicable laws.

  • Legitimate business purposes – such as providing services, improving operations, ensuring security, and preventing fraud.

7.3 European Union (EU)

If you are located in the European Economic Area (EEA), we process personal data only where a lawful basis under Article 6 of the General Data Protection Regulation (GDPR) applies. This includes processing that is:

  • Necessary for the performance of a contract with you, or to take steps prior to entering into a contract.

  • Based on your consent for one or more specific purposes.

  • Necessary to comply with legal obligations to which we are subject.

  • Necessary for our legitimate interests, provided those interests are not overridden by your rights and freedoms.

7.4 United Kingdom (UK)

If you are located in the UK, we process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The legal bases we rely on mirror those outlined for the EU in Section 7.3.

7.5 International

For jurisdictions outside of Canada, the United States, the European Union, and the United Kingdom, we will process personal data in accordance with applicable local privacy and data protection laws. Where no specific legal framework applies, we handle personal data in line with the principles of this Privacy Policy and rely on the following lawful bases, as appropriate:

  • Consent – when you have provided clear consent for us to process your personal data for a specific purpose.

  • Contractual necessity – when processing is necessary to provide you with services or fulfill our obligations under a contract.

  • Legal obligations – when processing is required to comply with a law or regulation.

  • Legitimate business interests – when processing is necessary for our legitimate business purposes (such as providing services, improving operations, ensuring security, and preventing fraud), provided those interests are not overridden by your rights and freedoms.

8. Who We Share Personal Data With

8.1 Employees
We may share personal data with employees or authorized personnel within our organization who require access to such data to perform their duties and to fulfill the purposes described in this Privacy Policy.

8.2 Third Parties and Partners
We may share your personal data with third-party partners, service providers, or with analytics and advertising partners as described in Section 5.3. Where required by law, we will seek your consent before such sharing.

Such partners may include, but are not limited to:

  • Marketing and advertising service providers

  • Data analytics providers

  • Event coordination teams

We take all reasonable measures to ensure that any third parties with whom we share your data comply with strict data protection standards and use your information solely for the purposes agreed upon.

Please note that if you follow links from our Site to external websites, we are not responsible for and have no control over the privacy practices or policies of those third-party sites.

9. Additional Disclosures

Depending on where you live, additional privacy rights or requirements may apply. We provide the following disclosures to ensure transparency across the jurisdictions in which we operate.

9.1 Canada

Under PIPEDA and applicable provincial privacy laws:

  • We will always identify the purposes for which we collect personal information.

  • We will not use or disclose your personal information for new purposes without your consent, unless permitted or required by law.

  • You have the right to access, correct, or challenge the accuracy of your personal information.

9.2 United States

Certain U.S. state privacy laws (such as the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), and others) grant residents specific rights. These may include:

  • The right to know what personal data we collect and how we use it.

  • The right to request access to or deletion of your personal data.

  • The right to opt out of the sale or sharing of personal data.

  • The right to non-discrimination for exercising privacy rights.

  • The right to correct personal data

9.2.1 Do Not Track (DNT) Notice

Do Not Track (DNT) is a browser setting that allows users to express their preference not to be tracked online. While LeadPerk itself does not track users across websites over time, our website uses third-party services—such as HubSpot, Google Ads, and Facebook—that may collect and track information about your browsing behavior across multiple sites.

As a result, we do not currently respond to browser-initiated DNT signals.

9.3 European Union (EU)

Under the General Data Protection Regulation (GDPR), you may have the following rights:

  • The right to access and receive a copy of your personal data.

  • The right to request rectification or erasure of personal data.

  • The right to restrict or object to processing, in certain circumstances.

  • The right to data portability.

  • The right to withdraw consent at any time, where consent is the basis for processing.

9.4 United Kingdom (UK)

Under the UK GDPR and the Data Protection Act 2018, individuals in the UK have rights equivalent to those listed for the EU in Section 9.3.

9.5 How to Exercise Your Rights

You can exercise any applicable privacy rights by contacting us using the details provided in our Contact Section or email privacy@leadperk.ca . We may need to verify your identity before responding to your request. We will respond within the timeframes required by applicable law.

9.6 Sale or Sharing of Personal Data
We do not sell personal data for monetary compensation. However, in certain circumstances we may share limited personal data with advertising partners for cross-context behavioral advertising, as described in Section 5.3. Where required by law (such as under the California Consumer Privacy Act), this type of activity may be considered “sharing.” You may opt out of such sharing at any time by following the instructions in Section 9.2 or by using the “Do Not Sell or Share My Personal Information” link available on our website.

In addition, we may disclose personal data in the following circumstances:

  • Legal requirements – when required by law, regulation, or legal process.

  • Business transactions – in connection with any potential or actual sale, merger, or acquisition of our company, provided that appropriate safeguards remain in place.

  • With your consent – as otherwise described in Section 8.2 (“Third Parties and Partners”), where sharing occurs only with your explicit consent.

9.7 Third-Party Links

If you follow links from our Site to external websites, please note that we are not responsible for and have no control over the privacy practices or policies of those third-party sites.

10. Cross-Border Data Transfers

We are based in Canada. When you share personal data with us (for example, by filling out a form on our website), that information may be transferred to and processed in Canada. In some cases, we may also transfer personal data to, store it in, or process it in other countries where we work with clients or service providers. We never transfer personal data unless it is necessary for the purposes described in this Privacy Policy, and when we do, we rely on the same legal bases for processing set out in Section 7.

10.1 Transfers from the European Union (EU) to Canada

Canada has been recognized by the European Commission as providing an adequate level of protection under the General Data Protection Regulation (GDPR). This means personal data can flow freely from the EU to Canada without additional safeguards.

10.2 Transfers from the United Kingdom (UK) to Canada

The UK government has also granted Canada adequacy status under the UK GDPR. This means personal data can be transferred from the UK to Canada without additional safeguards.

10.3 Transfers from the United States to Canada

When personal data is transferred from the United States to Canada (for example, when U.S. users fill out our forms), we handle it in line with PIPEDA and applicable provincial privacy laws in Canada. We also comply with relevant U.S. federal and state privacy laws, such as the California Consumer Privacy Act (CCPA/CPRA) and other state-level frameworks.

10.4 Other International Transfers

For transfers from other jurisdictions, we will take steps to ensure appropriate safeguards are in place so that personal data is afforded a level of protection consistent with applicable privacy laws.

No matter where your personal data originates, or where it is processed, we will only use it when we have a lawful reason to do so and only for purposes that are appropriate, necessary, and respectful of your privacy. Where we transfer personal data to countries without adequacy status, we implement appropriate safeguards, such as Standard Contractual Clauses (SCCs).

11. Data Retention and Storage Period

At LeadPerk, we keep personal data only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by law. When data is no longer needed, we will securely delete or anonymize it, unless retention is required by law.

We apply the following principles:

  • Purpose-driven – Data is retained only for the time needed to provide our services, carry out business operations, or meet legal, regulatory, or contractual obligations.

  • Limited storage – We do not keep personal data longer than necessary. For example, marketing and prospecting data is retained only while it remains relevant for outreach, and business records (such as invoices or contracts) are kept only as long as required by tax and accounting laws.

  • Regular review – We periodically review the personal data we hold and securely delete or anonymize information that is no longer needed.

  • Extended retention – In some cases, we may need to retain data for a longer period if it is reasonably necessary to:

    • comply with legal or tax obligations,

    • resolve disputes,

    • prevent fraud or abuse, or

    • enforce our agreements.

If we ever need to retain your personal data for longer than originally intended, we will notify you and, where legally required, seek your consent.

Storage Locations

Your personal data may be stored and processed in Canada, the United States, the United Kingdom, the European Union, or other jurisdictions where our service providers maintain secure facilities. We take steps to ensure that any such transfers are protected by appropriate safeguards, consistent with applicable data protection laws.

12. How We Protect Your Personal Data

At LeadPerk, we take all reasonable and practical precautions to safeguard your personal data and protect your privacy. We use a combination of technical, organizational, and administrative measures to help keep your information secure, including:

  • Technical safeguards such as encryption, secure servers, and firewalls.

  • Organizational measures such as restricting access to personal data to authorized personnel only.

  • Administrative practices such as staff training, confidentiality agreements, and regular reviews of our data handling practices.

Despite these measures, no method of transmission over the internet or method of electronic storage is entirely secure. A residual risk of unauthorized access or data compromise always remains. While we cannot guarantee absolute security, we are committed to protecting your personal data to the fullest extent reasonably practicable.

13. Your Privacy Rights

We respect your privacy and want you to feel in control of your personal data. Depending on where you live, you may have specific rights under privacy and data protection laws. These rights generally include the ability to:

  • Access the personal data we hold about you.

  • Request corrections or updates to your personal data.

  • Request the deletion of your personal data, subject to certain legal or contractual restrictions.

  • Restrict or object to the processing of your personal data.

  • Withdraw your consent where processing is based on consent.

  • Request a copy of your data in a portable format, where applicable.

  • Lodge a complaint with your local data protection authority if you believe your rights have been violated.

How to Access, Modify, Delete, or Challenge Your Data

If you wish to know whether we hold personal data about you, understand how it has been used, or know to whom it has been disclosed, you may contact us at any time. You may also request to access, update, correct, delete, or otherwise exercise any rights available to you under applicable privacy laws (such as the GDPR, UK GDPR, PIPEDA, or U.S. state privacy laws).

Parents or legal guardians of children under 16 who believe their child’s personal data has been collected are encouraged to contact us to request its removal.

14. Modifications

We may update this Privacy Policy from time to time to ensure compliance with applicable laws and to reflect changes in our data collection or processing practices. When such updates occur, we will revise the “Effective Date” at the top of this Policy.

We encourage you to review this Privacy Policy periodically to remain informed about how we protect your information. Where required by law, or if changes are significant, we may also notify you directly (for example, by email or a notice on our website).

15. Complaints

If you have concerns about how we handle your personal data, please contact us using the details provided in Section 16 (Contact). We will make every reasonable effort to address and resolve your concern promptly.

If you are not satisfied with our response, you may have the right to lodge a complaint with a supervisory authority. For individuals in the European Union, this may be the Data Protection Commission or the relevant data protection authority in your country of residence.
